These Terms of Service ("Terms") govern your access to and use of the website at gameqbatorlabs.com (the "Site"), operated by GameQbator Labs Inc. ("GameQbator Labs," "we," "us," or "our"). Press materials made available in the press kit section (logos, headshots, brand assets) may be used for legitimate editorial, journalistic, and partnership purposes. Use must accurately reflect GameQbator Labs and may not imply endorsement of unrelated products or services.
References on the Site to "Magic: The Gathering," "Pokemon," "Duel Masters," "KeyForge," "MLB Showdown," "NBA Showdown," "NFL Showdown," "Harry Potter," "X-Men," "Futbol Champions," "MetaZoo TCG," and any other third-party trading card game titles, characters, logos, or brands are the trademarks, service marks, and/or copyrighted works of their respective owners. GameQbator Labs claims no ownership of these marks.
References to these titles describe the prior professional experience of GameQbator Labs team members, or appear as nominative references for descriptive purposes only. Such references do not imply any current affiliation, endorsement, sponsorship, partnership, or other relationship with the trademark owners unless explicitly stated. By submitting information, you grant GameQbator Labs a non-exclusive, royalty-free license to use the information for the purpose of responding to your inquiry or providing the requested service.

We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses. Information presented on the Site about industry data, market sizes, and historical events is provided for informational purposes and may contain inaccuracies.
To the fullest extent permitted by applicable law, in no event shall GameQbator Labs, its affiliates, officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or use — arising out of or relating to your use of the Site, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from or relating to the Site shall not exceed one hundred U.S. dollars (US $100).
You agree to indemnify, defend, and hold harmless GameQbator Labs and its affiliates from any claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your misuse of the Site.
We may suspend or terminate your access to the Site at any time, without notice, for any reason — including for violation of these Terms.
These Terms are governed by the laws of the State of Washington, USA, without regard to conflict of laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Informal resolution first. Before filing any claim, you agree to attempt to resolve the dispute informally by contacting gameqbatorlabs.info@gmail.com. We will attempt to resolve the dispute by communicating with you. If a dispute is not resolved within 60 days of submission, you or GameQbator Labs may bring a formal proceeding.
Venue. Any dispute that is not resolved informally shall be brought exclusively in the state or federal courts located in King County, Washington, and you consent to the personal jurisdiction of those courts.
Time limitation. Any cause of action arising out of or related to the Site or these Terms must commence within one (1) year after the cause of action accrues. Otherwise, such cause of action is permanently barred.
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or if it cannot be so modified, severed from these Terms. The remaining provisions shall continue in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and GameQbator Labs Inc. concerning the Site, and supersede all prior or contemporaneous communications and proposals, whether oral or written, between you and us with respect to the Site.
Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision. No waiver of any provision of these Terms will be effective unless made in writing and signed by an authorized representative of GameQbator Labs Inc.
You may not assign or transfer these Terms or any rights or obligations under them, in whole or in part, by operation of law or otherwise, without our prior written consent. We may freely assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets, or by operation of law.
GameQbator Labs shall not be liable for any failure or delay in performance under these Terms due to causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, government action, labor disputes, internet or communication outages, hosting provider failures, pandemics, or supply chain disruptions.
These Terms are for the benefit of you and GameQbator Labs Inc. only. They are not intended to confer any rights or remedies on any third party.
We may update these Terms at any time. The "Last updated" date at the top will reflect changes. Material changes will be communicated via the Site. Continued use of the Site after changes constitutes acceptance of the updated Terms.
